City Council Votes 4 to 3 to Approve Application of NCD zoning to Broadway North of Chestnut.

The large majority of citizens who spoke at the council meeting 1/14/03 were opposed to rezoning.

City Lawyer advised council that resident's protest petition was not valid.

Lawsuit likely to stop application of NCD N. of Chestnut.

What you can do Now:

  • Write, Call, and e-mail our council members.

  • Ask them to find a compromise that will prevent tying up appropriate redevelopment of Broadway through unnecessary and costly court action.

  • Suggest removing existing residential structures from the rezoned area.

  • Ask that all new commercial structures be required to have a residential component, which is not part of the current NCD.

    These suggestion provide positive compromise for both residents and developers, allowing commercial development along Broadway North of Chestnut Street, while providing an increase in housing density while discouraging commercial development that is not residentially oriented.

    The Paine-Webber building on Charlotte Street is a perfect example of what could happen to Broadway

  • All it's design parameters fit within the requirements of the new NCD.

  • The building is not pedestrian friendly, and has had post construction modifications that make it even less pedestrian friendly than the original design.

  • Many Asheville Architects believe that it is a good example of how a bad building can be built even with good city imposed design parameters.

    Asheville City Council found the protest petition filed by neighborhood residents to be invalid due (in essence) to an inadequate number of signatures. There is some debate on this issue due to different interpretations of what percentage of land is owned by those who signed the petition (this is a very general description of a more complex issue. For more information contact the city legal department or one of your council members. Both Mayor Worley and Brian Peterson are lawyers and may be able to help explain).

    Rezoning of Broadway to the new NCD was passed by two separate votes. Unanimous for the land South of Chestnut, and a split 3/4 (Peterson, Bellamy, Jones against) vote for the land North of Chestnut. Due to the close vote, city council must vote a second time on the rezoning of the land North of Chestnut.
